Terms & Conditions

Effective date: 27 July 2026

These Terms & Conditions govern access to the Blooming Mind website and the booking, purchase and use of Blooming Mind services, assessments, reports, programmes and digital offerings.

By accessing the website, submitting an enquiry, booking an appointment, purchasing a service, beginning an assessment or otherwise using Blooming Mind’s services, you confirm that you have read and accepted these Terms.

Electronic acceptance, including acceptance through a website form, checkbox, payment flow or digital communication, may create a valid contractual relationship under applicable Indian law.

2. Scope of these Terms

These Terms apply to:

  • Website visitors
  • Enquirers
  • Clients
  • Assessment participants
  • Report purchasers
  • Review-session participants
  • Programme participants
  • Anyone purchasing a service for another person
  • Anyone accessing Blooming Mind content or digital systems

A service-specific page, informed-consent document, purchase notice or written agreement may contain additional terms.

Where a service-specific term directly differs from these general Terms, the service-specific term will apply to that service to the extent of the stated difference.

3. Eligibility

You must be legally capable of entering into a binding agreement to purchase or use Blooming Mind services independently.

Where a participant is a minor or otherwise requires a lawful representative, Blooming Mind may require:

  • Consent from a parent or lawful guardian
  • Identity or relationship verification
  • A separate informed-consent process
  • Additional professional assessment of suitability

Blooming Mind may decline or discontinue a service where appropriate consent, eligibility or suitability requirements are not met.

4. Nature and limits of services

Blooming Mind services are intended to support psychological understanding, emotional wellbeing, therapeutic work, reflection and personal growth.

They do not guarantee:

  • Diagnosis
  • Cure
  • Immediate relief
  • A particular emotional response
  • A specific personal or relationship outcome
  • Improvement within a fixed period
  • Prediction of future events
  • Certainty about a person’s history or circumstances
  • A particular recommendation
  • Agreement with the participant’s preferred interpretation

Therapy and reflective work may involve difficult, uncomfortable or unexpected emotions. Discomfort alone does not establish that a service was improperly delivered.

5. Psychological Blueprint™ and assessments

The Psychological Blueprint™ and other Blooming Mind assessments are designed for self-discovery, reflection and deeper personal understanding.

They are not:

  • Diagnostic instruments
  • Medical examinations
  • Emergency assessments
  • Substitutes for psychiatric, medical or psychological diagnosis
  • Guarantees of future behaviour or outcomes
  • Definitive statements about personality or identity
  • Evidence of childhood events, trauma, abuse, attachment history or family dynamics unless independently established

Assessment results depend substantially on the participant’s responses.

The participant is responsible for answering honestly, carefully and independently.

Blooming Mind is not responsible for an outcome materially affected by:

  • Random or rushed answers
  • Inaccurate responses
  • Intentionally misleading responses
  • Responses completed by another person
  • Misunderstood questions
  • Failure to read instructions
  • Changes in perspective after submission
  • A desire to present oneself in a particular way

6. Personalised reports

A personalised report reflects the responses and information available at the time of generation.

Interpretive content may include cautious, evidence-linked reflections intended to help the participant consider their profile more deeply.

The report does not promise that every statement will feel equally relevant.

Participants may:

  • Agree with some parts and not others
  • Find certain reflections more meaningful over time
  • Experience discomfort with an unexpected pattern
  • Bring questions to a separately booked review session

Disagreement with a report does not itself establish error, deficiency or entitlement to a refund.

Report refunds and technical remedies are governed by the separate Cancellation, Rescheduling & Refund Policy.

7. Blueprint Review Sessions and future review services

A Blueprint Review Session or other assessment-review session is a separately scheduled professional service unless expressly stated as included.

A review session may help the participant:

  • Understand profile patterns
  • Clarify language in the report
  • Reflect on areas of resonance or uncertainty
  • Consider relevant next steps

A review session does not guarantee:

  • Rescoring
  • Rewriting
  • A different result
  • Validation of the participant’s preferred interpretation
  • Therapy within the same appointment
  • A diagnosis
  • A refund for the report

Where therapy or another service appears relevant, it may be discussed as an optional next step without creating an obligation to purchase.

8. Therapy and professional relationship

A therapeutic or professional relationship is created only when Blooming Mind has:

  • Accepted the booking or engagement,
  • Confirmed the service,
  • Obtained any required consent, and
  • Begun providing the agreed professional service.

Browsing the website, sending a message or completing a general enquiry does not by itself create a therapist-client relationship.

Blooming Mind may determine that a particular service is not suitable or that another professional or level of care would be more appropriate.

Where appropriate, Blooming Mind may:

  • Decline a booking
  • Recommend another practitioner or service
  • Pause or discontinue a service
  • Refer the client for psychiatric, medical or emergency support
  • Require additional consent or assessment

9. Emergencies and crisis support

Blooming Mind’s website, WhatsApp, email, assessments and ordinary scheduled sessions are not emergency-response services.

Do not rely on them for:

  • Immediate crisis intervention
  • Medical emergencies
  • Imminent risk of self-harm
  • Imminent risk of harm to another person
  • Acute psychiatric emergencies
  • Urgent safeguarding concerns

In an emergency, contact local emergency services, the nearest hospital, an appropriate crisis service or a trusted person who can provide immediate assistance.

Blooming Mind does not guarantee continuous monitoring of messages outside scheduled working arrangements.

10. Appointments

Appointments are subject to:

  • Availability
  • Confirmation
  • Timely payment where required
  • Completion of required information or consent
  • Compliance with the Cancellation, Rescheduling & Refund Policy

Clients must provide accurate contact information and check booking confirmations, reminders and joining instructions.

The detailed rules for cancellation, rescheduling, late arrival and no-shows are contained in the separate Cancellation, Rescheduling & Refund Policy, which forms part of these Terms.

11. Online sessions

For online services, the client is responsible for:

  • A suitable device
  • Reliable internet access
  • Working audio and video where required
  • A private and reasonably secure location
  • Joining at the scheduled time
  • Protecting meeting links and access credentials
  • Not recording the session without express permission

Blooming Mind will take reasonable steps to provide secure and reliable online access but cannot guarantee uninterrupted third-party networks or client-side technology.

12. Confidentiality

Information shared during therapy or psychological services will ordinarily be treated as confidential.

Confidentiality may be limited where:

  • Disclosure is required by law
  • A lawful authority requires disclosure
  • There is a serious and immediate safety concern
  • Reporting is legally required
  • Disclosure is necessary to establish, exercise or defend a legal claim
  • The client gives clear permission
  • Professional supervision or consultation is required and appropriate safeguards are used

Specific confidentiality arrangements may also be explained through a separate informed-consent process.

13. Recording and use of session material

Clients may not record, livestream, transcribe, distribute or publish any session without Blooming Mind’s prior written consent.

Blooming Mind will not ordinarily record a session without informing the client and obtaining appropriate consent.

Unauthorised recording may result in termination of the session or service.

14. Communication boundaries

WhatsApp, telephone and email may be used for:

  • Enquiries
  • Booking administration
  • Appointment reminders
  • Report delivery
  • Payment or service information
  • Limited follow-up communication
  • Support relating to purchased services

These channels are not substitutes for scheduled therapy and may not be monitored continuously.

Lengthy therapeutic discussions, crisis communication or repeated unscheduled professional requests may require a booked session.

Clients should avoid sending unnecessary sensitive information through ordinary communication channels.

15. Client responsibilities

Clients and participants agree to:

  • Provide accurate information
  • Attend appointments on time
  • Communicate respectfully
  • Avoid abusive, threatening or discriminatory behaviour
  • Protect their own account, links and reports
  • Use services only for lawful personal purposes
  • Avoid impersonation or fraudulent bookings
  • Avoid submitting another person’s responses without authority
  • Avoid interfering with website or assessment systems
  • Inform Blooming Mind of relevant practical or safety concerns where necessary for service delivery

Blooming Mind may suspend or terminate access where these responsibilities are materially breached.

16. Practitioner responsibilities and professional judgement

Blooming Mind will seek to provide services with reasonable care, skill, confidentiality and professional judgement.

Professional judgement may include:

  • Asking reflective or difficult questions
  • Declining to confirm an unsupported conclusion
  • Recommending a different service
  • Referring to another professional
  • Pausing or ending a service that is no longer suitable
  • Setting communication boundaries
  • Declining a request that is unsafe, unethical or outside scope

A client’s disagreement with professional judgement does not by itself establish negligence or service deficiency.

17. Fees and payment

Current fees will ordinarily be stated on the website, booking page, payment request or direct communication.

Unless otherwise agreed:

  • Payment must be made by the stated deadline
  • A booking may remain unconfirmed until payment is received
  • Prices may change for future purchases
  • A later promotional price does not apply retrospectively
  • Taxes or payment-processing charges may apply where stated
  • Packages may have separate validity and usage terms

Blooming Mind is not responsible for payment failure caused by a bank, gateway, card network or client-side issue.

18. Cancellation, rescheduling and refunds

The separate Cancellation, Rescheduling & Refund Policy forms part of these Terms.

It governs:

  • Appointment cancellations
  • Rescheduling
  • No-shows
  • Late arrival
  • Client-side technical failure
  • Packages
  • Assessment completion
  • Report generation
  • Subjective dissatisfaction
  • Duplicate payments
  • Technical defects
  • Refund processing
  • Chargebacks

By booking or purchasing, you agree to that Policy.

19. Privacy and personal data

Blooming Mind processes personal information in accordance with the published Privacy Policy and applicable Indian law.

The Privacy Policy explains:

  • Information collected
  • Purposes of processing
  • Assessment and report data
  • WhatsApp and email communication
  • Service providers
  • Retention
  • Security
  • Rights and grievances
  • Consent and withdrawal

The Digital Personal Data Protection framework requires clear notice, safeguards, rights handling and grievance mechanisms, and Blooming Mind’s operational practices must align with the published policy.

20. Technology-supported processing

Blooming Mind may use secure digital systems and authorised providers for:

  • Assessment administration
  • Scoring
  • Structured interpretation
  • Quality checks
  • Report generation
  • PDF creation
  • Storage
  • Communication
  • Delivery
  • Security monitoring

Technology-supported processing does not change the reflective and non-diagnostic nature of the Psychological Blueprint™.

Blooming Mind will seek to use appropriate safeguards and restrict providers to the processing reasonably required for their function.

21. Third-party services

Blooming Mind may rely on third parties such as:

  • Website hosting providers
  • Cloud infrastructure providers
  • Payment gateways
  • Email providers
  • WhatsApp or messaging providers
  • Video-meeting platforms
  • Google Maps
  • Analytics and security providers

Third-party services may be governed by their own terms and privacy policies.

Blooming Mind is not responsible for a third party’s independent acts, outages or policies, but will take reasonable steps when selecting providers and responding to service disruptions.

22. Website availability

Blooming Mind seeks to keep the website and digital services available but does not guarantee uninterrupted or error-free access.

Access may be interrupted for:

  • Maintenance
  • Updates
  • Security work
  • Hosting failure
  • Network failure
  • Third-party outage
  • Cybersecurity incidents
  • Events outside reasonable control

Blooming Mind may alter, suspend or discontinue website features where reasonably necessary.

Where a paid service is materially affected, the remedies stated in the Refund Policy will apply.

23. Intellectual property

Unless otherwise stated, the website and its original materials belong to Blooming Mind or are used with permission.

This includes:

  • The Blooming Mind name and branding
  • Psychological Blueprint™
  • Pattern Synthesis™
  • Assessment architecture
  • Questions and response structures
  • Reports
  • Written content
  • Page designs
  • Graphics
  • Documents
  • Educational material
  • Processes and frameworks

You may not, without written permission:

  • Copy substantial parts
  • Republish
  • Sell
  • License
  • Scrape
  • Reverse engineer
  • Reproduce assessment questions
  • Create derivative commercial products
  • Remove branding
  • Use materials to train or build another assessment or report system
  • Distribute private links or access credentials

Nothing in these Terms claims exclusive rights beyond those genuinely owned or legally protectable by Blooming Mind.

24. Personal licence to use reports and materials

A purchased report is provided for the participant’s personal use.

The participant may:

  • Read it
  • Store it
  • Print it
  • Share it privately with a therapist, doctor, partner or trusted person

The participant may not:

  • Resell it
  • Publish it as a commercial product
  • Remove ownership notices
  • Present it as their own assessment system
  • Use it to assess another person
  • Reproduce its structure commercially
  • Upload or distribute it in a way that infringes Blooming Mind’s rights

Participants remain responsible for deciding with whom they share sensitive personal reports.

25. Website content and educational information

Website articles and educational content are general information only.

They are not:

  • Personal medical advice
  • Personal psychological advice
  • Diagnosis
  • Emergency guidance
  • A substitute for an individual professional assessment
  • A guarantee that a service is suitable for every person

Users should seek appropriate professional support for individual circumstances.

26. Testimonials and reflections

Client reflections may appear in anonymised form.

Testimonials describe individual experiences and do not guarantee that another person will have the same outcome.

Blooming Mind will not knowingly publish identifiable client information without appropriate permission.

27. Prohibited use

You must not:

  • Use the website unlawfully
  • Attempt unauthorised access
  • Introduce malware
  • Disrupt the website
  • Scrape protected content
  • Circumvent assessment controls
  • Manipulate submissions
  • Attempt to obtain another participant’s report
  • Misuse personal-data access routes
  • Make fraudulent purchases or chargebacks
  • Impersonate another person
  • Harass Blooming Mind staff, practitioners or clients
  • Use content to misrepresent qualifications or clinical authority

Blooming Mind may block access, preserve evidence and take appropriate legal action where misuse occurs.

28. Service refusal, suspension or termination

Blooming Mind may refuse, pause or terminate a service where reasonably necessary because of:

  • Safety concerns
  • Unsuitability of service
  • Non-payment
  • Abuse or threats
  • Repeated boundary violations
  • Fraud
  • Misrepresentation
  • Illegal conduct
  • Serious disruption
  • Conflict of interest
  • Lack of required consent
  • A need for a more appropriate level of care

Where applicable, payment consequences will be assessed under the Refund Policy and applicable law.

Termination will not remove payment obligations for services already delivered or appointment time already consumed.

29. Limitation of responsibility

Blooming Mind does not exclude responsibility that cannot lawfully be excluded.

Subject to that qualification, Blooming Mind is not responsible for loss arising solely from:

  • Reliance on general website content as personal advice
  • Inaccurate participant information
  • Failure to follow instructions
  • Client-side technical failure
  • Unauthorised sharing of a report by the participant
  • Independent third-party conduct
  • Decisions made without appropriate professional advice
  • Expectations or outcomes that were never expressly promised
  • Events outside reasonable control

Nothing in these Terms is intended to excuse fraud, wilful misconduct, material service deficiency or breach of a non-excludable statutory duty.

30. No guaranteed outcomes

Blooming Mind does not guarantee:

  • Recovery

  • Symptom elimination
  • Business, career or financial outcomes
  • Spiritual outcomes
  • A particular assessment result

Blooming Mind will seek to investigate and respond within a reasonable period.

Nothing in these Terms prevents a consumer from using a lawful consumer grievance mechanism. The National Consumer Helpline is an official pre-litigation grievance mechanism of the Department of Consumer Affairs.

32. Fairness and consumer rights

These Terms must be read subject to applicable consumer law.

Nothing in them excludes or restricts a right that cannot lawfully be excluded.

The Consumer Protection Act, 2019 permits unfair contractual terms to be examined and, in appropriate cases, declared void. These Terms are intended to protect legitimate professional time, delivered services and personalised work without excluding remedies for genuine material deficiency, duplicate charging or unresolved non-delivery.

33. Disputes

The parties should first attempt to resolve a dispute through direct written communication and good-faith discussion.

Where a dispute remains unresolved, either party may use any mediation, consumer grievance or legal process available under applicable law.

Nothing in these Terms requires a consumer to waive a statutory forum or remedy that cannot lawfully be waived.

34. Governing law and jurisdiction

These Terms are governed by the laws of India.

Subject to any mandatory consumer forum or statutory jurisdiction, courts and competent authorities in Pune, Maharashtra will have jurisdiction over disputes connected with Blooming Mind services.

35. Severability

If a provision of these Terms is found unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent required.

The remaining provisions will continue to apply.

36. No waiver

If Blooming Mind does not immediately enforce a provision, that does not mean the provision has been permanently waived.

A waiver in one situation does not automatically apply to another situation.

37. Changes to these Terms

Blooming Mind may update these Terms when services, technology, legal requirements or operating practices change.

The revised version will be published with an updated effective date.

The terms ordinarily applicable to a purchase will be those made available at the time of purchase, subject to later changes required by law.

38. Entire agreement

These Terms, together with the applicable:

  • Service description
  • Consent notice
  • Privacy Policy
  • Cancellation, Rescheduling & Refund Policy
  • Purchase confirmation
  • Written service-specific agreement

form the agreement governing the relevant service.

They replace prior general website statements on the same subject but do not override a later written service-specific agreement.
